1. Introduction

b. The following terms and conditions (“Agreement”) govern all use of the Bearer Of Good News ("Artist") website (“Website”) and the products (“Products”) available on or at the Website.
c. The Website enables you, the customer ("Customer") to shop online for an extensive range of art related products and accessories.
d. Products offered by a Third Party involved such as a printing company ("Third Party") are offered subject to your acceptance without modification of all of the terms and conditions contained herein and all other operating rules, policies and procedures that may be published from time to time on the Website by Bearer Of Good News.
e. Bearer Of Good News permits the use of this Website subject to the Terms & Conditions. By using this website or the Artist's service in any way, you shall be deemed to have accepted all the Terms & Conditions unconditionally. If the Customer does not agree to this Agreement, it will not have the right to use the Website nor the Artist's service.
2. Returns
A printed artwork is produced by a Third Party involved and is handled with the utmost care during the printing and manufacturing process. In the unlikely circumstance of your delivery being damaged in transit, please photograph the packaging prior to opening the delivery and then photograph the damaged art inside.

3. Use of the website
a. By using the Website you warrant that you are 18 (eigtheen) years of age or older and of full legal capacity. If you are under the age of 18 (eighteen) or are not legally permitted to enter into a binding agreement, then you may use the Website only with involvement and supervision of your parent or legal guardian. Bearer Of Good News presumes that minors who carry out purchases on www.bearerofgoodnews.co.za submit truthful information of their age and/or possess the necessary consent from their custodian to purchase the item(s). If your parent or legal guardian supervises you and gives his/ her consent, then such person agrees to be bound to these Terms & Conditions and to be liable and responsible for you and all your obligations under these Terms & Conditions.
b. You may not in any way display, publish, copy, print, post ot otherwise use the Website and/ or the information contained therein without the prior written consent of Bearer Of Good News.
4. Payment
a. A 100% full upfront payment is required, unless agreed otherwise. Upon receiving of invoice personally curated by the Owner of Bearer Of Good News, payment can be made for Goods via -
i. direct bank deposit, electronic funds transfer or instant EFT: Bearer Of Good News will not accept your order if payment has not been received within 2 (two) days of placing your order.
b. We will send you email communications about your order and payment.
c. Once an order has been confirmed and paid by the Customer, it will receive an order confirmation by Bearer Of Good News to the e-mail address provided. If no confirmation from us has been sent, no purchase has been made.
5. Delivery of goods
a. Delivery of Goods is possible via courier; and self-collection.
b. The Third Party involved will deliver your accepted order to you as soon as reasonably possible. Please note however that Bearer Of Good News makes no guarantees on the exact delivery time, but will work as hard as possible to make sure that delivery is being made within the given time frame. Bearer Of Good News will notify the Customer of any known delays.
c. Bearer Of Good News can and will not be held responsible by the work of any Third Party involved.
d. Bearer Of Good News is not responsible for:
i. wrongful information provided by the Customer, such as full name, delivery address, e-mail and phone number.
ii. any loss or unauthorised use of the product after delivery to the physical address given by you has taken place.
6. Privacy Policy
a. We respect your privacy and value it highly, therefore we will treat your personal identifiable information as strictly confidential. We may ask you to provide us with several different types of information that can be used to identify and contact you ("Personal Data"). Your personal identifiable information may include, but is not limited to:
i. first and last name
ii. email address
iii. phone number
iv. physical address
b. We will only make use of your information for the sole purpose:
i. to operate the Website
ii. in relation to the ordering , sale and delivery of Goods through us and/ or by third party service providers who assist us to interact with you via our Website, email or any other method in order to communicate with you properly and efficiently.
c. Should your personal information change, please inform us at reasonable timing to ensure we update your personal information before your order is placed for printing and delivery.
e. We will ensure that our third party providers (including their employees and third party service providers) having access to your personal information are bound by appropriate and legally binding confidentiality and non-use obligations in relation to your personal information.
7. Refund Policy
a. Deposits are non-refundable.
b. Refunds (if applicable)
We will notify you of the approval or rejection of your refund based on the following:
i. From the moment full payment is made by the Customer, the Customer has 24 (twenty four) hours to email bearerofgoodnewsonline@gmail.com to cancel their order. Bearer Of Good News is not bound to process any refunds to the Customer's order if the changes are requested later than that. After 24 (twenty four) hours, any payment made is non-refundable.
ii. If the Customer requests a refund in the following 24 (twenty four) hours after their invoice is paid, a refund will be processed.
c. Returns (if applicable)
i. To be eligible for a return, your item must be unused and in the same condition that you received it. It must also be in the original packaging.
ii. A proof of purchase is required to complete your return.
8. Ownership & Copyright
a. The copyright in the Website; Products and other material (collectively referred to as the “Material”), including without limitation the text, artwork, design, logos, posters, photographs, images, music, audio, video, computer code and the selection and arrangement thereof) are owned by Bearer Of Good News or a third party.
b. The use of the Material, including, but not limited to, reproduction, modification, distribution, republication, display or communication of any kind, is strictly prohibited without the prior written consent by the artist.
c. You will not acquire any right, title or interest in or to the Website or the Website Content.
d. The Customer acknowledges that any goodwill and reputation created in respect of any trademark, business name or logo belonging to Bearer Of Good News shall remain the sole and exclusive property of Bearer Of Good News and that no part of this agreement is intended to transfer any intellectual property rights or any other rights vested in the Website, except for the rights granted under this Agreement, which are only for the Customer’s personal, non-commercial use.
e. Any work by the Artist may not be reproduced, redistributed or modified. It may also not be used for commercial purposes, including but not limited to trademarks/ logo's, merchandise production, artwork used in films and on TV, in publications that are sold and online or offline advertisements and commercial promotions. Artwork converted to personal use such as a tattoo design will be granted only with a written approval by the Artist and at an additional fee.
9. Changes to these terms & conditions
Bearer Of Good News reserves the right to modify this Agreement, prices, fees, charges or terms at any time without the Customer’s notice. The Customer of the Website shall be responsible for reviewing and becoming familiar with any such modifications. Use of the Services by the Customer following such notification constitutes the Customer’s acceptance of the terms and conditions of changes as modified.
